On June 2, 2023, the Florida Judicial Qualifications Commission investigated and found that Scherer violated several rules of judicial conduct during Cruz’s trial.

Additionally, she made baseless accusations against one of Cruz’s attorneys and inappropriately kissed members of the prosecution team after the trial concluded.
The Commission recommended a public reprimand for Scherer, subsequently issued the following month.
